The agreement between LetsVisit and the businesses that list here: what we check, what we charge, and what each of us owes travellers. This document is available in English and Slovenian. The English version is shown here.
Not yet in force. This text is complete, but it takes effect only once the company behind LetsVisit is registered, its details appear below, and the text has been reviewed by a lawyer. Until then nothing on this page binds you or us. Questions in the meantime: info@letsvisit.si.
1.The parties and what this agreement covers
These terms are an agreement between the company that operates LetsVisit (“LetsVisit”, “we”) and the business that lists a service on letsvisit.si (“the provider”, “you”). They cover listing, taking booking requests, payment collection and payouts, and our commission. You accept them when you submit a listing for review. The Terms of use and booking that travellers accept also describe our role, and you agree to be bound by what they say about providers.
2.Our role
LetsVisit is an online marketplace and the provider’s agent for collecting payment. We present your offer, pass travellers’ requests to you and, once card payments are live, collect payment on your behalf. We are not a party to the contract for your service: when you confirm a request, the contract is between you and the traveller, and you are the seller and the provider of the service. We do not organise package travel and do not combine your service with others into a package.
3.Who may list, and what we check
You must be a registered business (a company or a sole trader) entitled to provide the service you list, and the person submitting the listing must be entitled to act for it. Before a listing goes live we ask for, and may check against public registers: the business’s legal name, address, registration number and VAT number, contact details, and any licence the service requires — for accommodation the registration in the RNO register, for guiding and adventure activities the licence or qualification you state.
The badge on your listing says exactly what we checked and when. It is never a statement that your service is good, safe or suitable; you remain responsible for that.
4.Your listing
You warrant that everything you publish is accurate, current and yours to publish:
- descriptions, inclusions, meeting points and conditions are true and complete;
- photographs show your own service and you hold the rights to them;
- prices are total prices including VAT, with anything payable on top (such as tourist tax) stated;
- your cancellation policy is stated clearly, and is no stricter than the law allows;
- availability is kept up to date, so that you do not confirm what you cannot provide.
We may format, shorten or translate your text for display, including by machine translation, which we label as such. We may refuse, correct or remove a listing that is inaccurate, unlawful or breaches these terms, and we tell you why.
5.Requests and confirmations
Bookings arrive as requests. You have 24 hours to confirm or decline, or half the time remaining before the service if that is sooner, and at least one hour; a request not answered in time lapses. Confirming a request makes a binding contract between you and the traveller at the price confirmed.
You may confirm at a lower price than the one quoted, never a higher one: decline and invite a new request instead. Answer promptly and honestly; repeated late answers or declines of requests you could have accepted lower your response rate, which is shown on your listing.
6.Payment collection and payouts
You appoint LetsVisit as your limited agent to collect payment from travellers for bookings made here. A traveller’s payment to us counts as payment to you, and discharges the traveller’s obligation to you for that amount. The traveller’s card is authorised when the request is made and charged when you confirm.
We pay out the amount collected, less our commission, to the account you connect with our payment provider, on the schedule shown in your account. Refunds owed to travellers because you cancelled or did not provide the service, and chargebacks on your bookings, are deducted from your payouts or, where they cannot be, invoiced to you.
Until card payments are switched on, travellers send requests without a card and pay you directly; we invoice our commission on confirmed bookings monthly.
Still to be filled in:
- The payout schedule (for example, a set number of days after the service date) once the payment provider is connected
7.Commission
Listing is free. Our commission is 12% of the amount collected for stays and 15% for every other kind of service, charged only on bookings that are confirmed and paid, and only on the amount actually taken. It is all-in: there are no listing fees, no featured placement, no visibility programmes and no fee that buys a better position.
We issue you an invoice for our commission, with VAT where it applies. Changes to the commission rates are announced at least 15 days in advance and never apply to bookings already confirmed.
8.Your obligations to travellers and the law
You are responsible for:
- providing the service as described and confirmed, safely, and with the insurance it requires;
- issuing the traveller an invoice or receipt for the service, and meeting your tax obligations, including VAT, tourist tax and fiscal verification of invoices where it applies;
- holding and keeping valid every licence, registration and permit the service requires;
- handling complaints about your service, and honouring the traveller’s consumer rights;
- using the travellers’ details we pass to you only to provide the booked service, as an independent controller under the GDPR.
9.When you cancel
If you have to cancel a confirmed booking, tell the traveller and us at once. The traveller is entitled to a full refund of everything paid through LetsVisit, whatever your cancellation policy says, and we deduct it from your payouts. Cancelling for safety reasons, such as weather that makes an outdoor activity unsafe, is not a breach, provided you offer what your listing says you will. Repeated cancellations may lead to suspension.
10.How listings are ranked
Listings are ranked by relevance to what the traveller asked for: whether the service matches the kind of thing, the place and the constraints they gave, how far it is from them, and its rating, weighted so that a few reviews do not outrank many. Ranking cannot be bought. No payment, commission level or other consideration affects the position of a listing, and no provider receives different treatment in ranking from any other.
11.Reviews
Travellers may rate and review your service. You may reply publicly, but you may not edit, buy, suppress or reward reviews, review your own service, or ask anyone to do so. We remove reviews that are fake, abusive or unlawful, not reviews that are merely negative.
12.Suspension and termination
You may end this agreement at any time by closing your listing; bookings already confirmed must still be honoured. We may end it with 30 days’ notice, giving our reasons.
We may suspend or remove a listing, or end the agreement immediately, where the law requires it, or for a serious or repeated breach: false or misleading information, a missing licence, unsafe practice, fraud, or abuse of travellers. Before or at the time it takes effect we give you a statement of reasons, and you may contest it through the complaint process below. After termination you keep access to the records of your bookings for as long as we are required to hold them.
13.Complaints and mediation
Complaints about anything we do under this agreement, including a decision about your listing, go to info@letsvisit.si. We consider each one, and answer within ten working days with our decision and the reasons for it. If a dispute remains, we are willing to try mediation in good faith with either of the mediators named below before going to court.
Still to be filled in:
- Two mediators LetsVisit is willing to use, as the Platform-to-Business Regulation requires
14.Liability
You indemnify LetsVisit against claims by travellers or third parties arising from your service, your listing or your breach of these terms. Our liability to you under this agreement is limited to the commission you paid us in the twelve months before the claim arose.
Neither limit applies to liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for loss caused intentionally or by gross negligence.
15.Changes, law and courts
We tell you about changes to these terms at least 15 days before they take effect, longer where a change requires you to make technical or commercial adjustments; you may end the agreement before then if you do not accept them. This agreement is governed by the law of the Republic of Slovenia, and the competent court in Ljubljana has jurisdiction.
Who to contact
The registered company name, address, registration number and VAT number are not published here yet. They will appear here when the company behind LetsVisit is registered, and before any payment is taken through this site.
